Alaska Real Estate Recovery Fund

A consumer protection fund under AS 08.88.450-.495, financed by a recovery fund fee collected with license fees. A person who lost money in a real estate transaction through a licensee's fraud, intentional tort, deceit, or conversion of trust funds may claim after obtaining a final judgment, arbitration award, or settlement and showing it is uncollectable. Payouts are capped at $15,000 per transaction and $50,000 per licensee, and claims must be filed within two years.

Exam tip
The cap is per transaction, not per claimant: several victims of one sale share $15,000. After paying, the Commission is subrogated to the claimant's rights and may suspend the licensee.
Example
Three buyers lose $12,000, $9,000, and $6,000 in the same sale. Even though losses total $27,000, the fund pays at most $15,000, split among them.
