Waiver of Duties Statement (Arkansas)

A signed statement under Ark. Code §17-42-319 that lets a client give up specific seller or buyer duties listed in §17-42-317 or §17-42-318, such as for limited MLS-entry service. It must list the non-waivable §316 duties, let the client mark each duty waived, and print the agreement language in at least 10-point bold type with signatures of client and licensee. Afterward, the licensee must tell other licensees not to send earnest money or deposits to the licensee and that offers may go directly to the principal.

Exam tip
Only §317/§318 duties can be waived, never the §316 fidelity duties. Once duties are waived, the licensee does not handle the money.
Example
A seller wants only an MLS entry and signs the waiver statement. A buyer's agent must then deliver earnest money elsewhere and may present offers directly to the seller.
