CC&Rs
CC&Rs, or covenants, conditions, and restrictions, are the recorded rules that govern use of property in a subdivision, condominium, or planned unit development. They may control architecture, landscaping, pets, parking, rentals, and maintenance, and they typically empower a homeowners association to collect dues and enforce rules. Buyers should review CC&Rs before closing, since they bind all owners.
- Exam tip
- CC&Rs are private deed restrictions, not public zoning. They run with the land, so new owners are bound even if they never signed them.
- Example
- A buyer learns from the CC&Rs that her new community bans short-term rentals, so she cannot list the home on vacation rental sites.
