Transaction-Broker (Colorado)
Colorado's default brokerage relationship. Under C.R.S. 12-10-403(2) a broker is presumed to be a transaction-broker unless a single-agency relationship is established in writing. A transaction-broker assists parties without being an agent or advocate for any of them. It owes all parties reasonable skill and care, presentation of all offers, accounting, and disclosure of known adverse material facts, but without consent of all parties may not reveal price flexibility, motivation, other financing terms, or psychological stigma.
- Exam tip
- When a question gives no written agency agreement, the Colorado broker is a transaction-broker, not a dual agent or seller's subagent.
- Example
- A seller privately tells the transaction-broker she would take $610,000. The broker may not share that with the buyer, but must disclose that the basement floods every spring.
