condemnation

Condemnation is the legal process a government or authorized entity uses to take private property for public use under its power of eminent domain. The owner must receive just compensation, usually based on the property's market value. If the parties cannot agree on price, a court decides. The term can also refer to declaring a building unfit for occupancy, but on licensing exams it most often means the taking process.

Exam tip
Eminent domain is the power; condemnation is the process of using it. Just compensation is required, and the use must be public.
Example
The state files a condemnation action to acquire a strip of a homeowner's front yard to widen a highway and pays the appraised value.
