Dual Agency Consent Agreement (Connecticut)

The statutory addendum under §20-325g that creates a conclusive presumption of informed consent to dual agency if signed before any purchase, sale, or lease contract is executed. Signed by buyer, seller, and the brokerage, it confirms the firm represents both and bars disclosure without written instruction that the seller will accept less, that the buyer will pay more, either party's motivation, or willingness to accept other financing terms. Known material defects must still be disclosed.

Exam tip
'Sign before you bind.' The four secrets are less, more, why, and how; known defects are never confidential in dual agency.
Example
A Stamford seller tells the dual-agency firm she would go to $410,000. The firm cannot share that with the buyer, but must disclose the roof leak she knows about.
