Stigmatized Property Rule (DC)
Under D.C. Code §47-2853.198, certain facts are not material facts requiring disclosure, and failing to disclose them cannot support a lawsuit: that an occupant had or was suspected of having HIV or AIDS or another disease medically shown to be highly unlikely to spread through occupancy, and that the property was the site of a suicide, homicide, or other felony. A licensee's separate duty to disclose known material adverse physical defects still applies.
- Exam tip
- In DC a suicide, homicide, or felony on the property is not a required disclosure, but physical defects always are.
- Example
- A listing agent knows a homicide occurred in a rowhouse years ago. DC law does not require her to disclose it, and the buyer cannot sue for the nondisclosure.
