Psychologically Impacted Property (Delaware)
Under 24 Del. C. §2927, a property stigmatized by an event such as a murder, suicide, felony, or reported haunting is psychologically impacted, and that fact is not a material fact requiring disclosure. No cause of action arises for nondisclosure, but if a buyer or tenant makes a specific written request, the owner or licensee must answer truthfully. HIV, AIDS, or similar diseases are never disclosed, even if asked. Questions about registered sex offenders are referred to the Delaware State Police.
- Exam tip
- 'Ghosts: only on paper. HIV: never. Offenders: call the State Police.' Physical damage from an event is a defect and must be disclosed.
- Example
- A buyer emails asking whether anyone died in the house. Because the request is in writing, the agent must answer truthfully.
