DUCIOA Resale Certificate (Delaware)

Under the Delaware Uniform Common Interest Ownership Act (25 Del. C. §81-409), a unit owner reselling in a common interest community must give the purchaser, no later than contract signing, the declaration, bylaws, rules, and a resale certificate current within 120 days. The association must provide it within 10 days of request for a fee capped at $200 (plus $50 for paper). A purchaser who did not receive it before signing may cancel within 5 calendar days of receipt, and is not liable for unpaid assessments above the stated amount.

Exam tip
'10 to deliver, 200 to charge, 5 to cancel, 120 fresh.' An association that misses the 10-day deadline cannot charge a fee.
Example
The certificate shows $300 in unpaid dues, but the association later claims $900. The buyer is liable for no more than the $300 stated.
