delivery and acceptance
Delivery and acceptance are the final steps needed for a deed to transfer title. Delivery means the grantor intends to transfer title and gives up control of the deed, either directly to the grantee or through an agent such as an escrow agent. Acceptance means the grantee agrees to take the deed, which is usually presumed when the transfer benefits the grantee. Title passes on delivery and acceptance, not on signing or recording.
- Exam tip
- Title passes when a deed is delivered and accepted while the grantor is alive. A signed deed left in the grantor's drawer has not transferred title.
- Example
- A father signs a deed to his son but keeps it in his safe until his death; because it was never delivered, title did not pass.
