Brokerage Engagement Rules (Georgia)
In Georgia a listing or buyer agreement is a brokerage engagement. GREC Rule 520-1-.06(1) requires every exclusive engagement to state a definite expiration date, requires a true copy to each signer at signing, and prohibits net brokerage engagements, in which the broker keeps everything above a set price. Since January 1, 2024, BRRETA also voids engagements that run with the land, bind future owners, or create a recordable lien, targeting long-term listing-right contracts.
- Exam tip
- 'Date it, copy it, gross it.' Net listings and exclusive listings with no expiration date are the two prohibited practices to know.
- Example
- A seller says, 'I need $400,000 in my pocket; anything over is yours.' The agent must refuse the net arrangement and instead show a gross price with the fee added.
