good consideration
Good consideration is something given out of love, affection, or a sense of moral duty, rather than money or something of measurable value. A gift deed to a family member, for example, may recite love and affection as consideration. Good consideration can support a deed, but it usually does not make an executory promise enforceable the way valuable consideration does.
- Exam tip
- Contrast good consideration (love and affection) with valuable consideration (money, property, services, or a promise of something of value).
- Example
- A father deeds a cabin to his daughter "for love and affection." The deed is supported by good consideration.
