Hawaii Conveyance Tax and HARPTA

Hawaii's conveyance tax (HRS 247) applies to deeds, agreements of sale, and leases of five years or more, on full consideration including liens. Rates are graduated per $100, from 10 cents under $600,000 up to $1.00 at $10 million, with a higher schedule for condos or homes bought by buyers ineligible for the homeowner's exemption; the whole price is taxed at its bracket rate. Separately, HARPTA requires the buyer to withhold 7.25% of the amount realized from nonresident sellers, including mainland residents, and remit it within 20 days.

Exam tip
Brackets are not marginal. HARPTA is 7.25%, withheld by the buyer, and applies to nonresidents; FIRPTA applies only to foreign persons.
Example
A California resident sells a Maui rental condo for $700,000 to an investor. HARPTA withholding is $50,750 and conveyance tax is $1,750.
