Groundwater Hazard Statement (Iowa)

A statement under Iowa Code 558.69, signed by the seller or seller's agent, that must accompany each declaration of value when a deed is recorded. It discloses wells, potentially hazardous solid waste disposal sites, underground storage tanks, hazardous waste, private burial sites, and private sewage disposal systems, including whether the septic system was inspected. If none exist, the first page of the deed carries a prescribed statement instead. The recorder refuses to record documents missing the required statement.

Exam tip
The owner is responsible for accuracy; an agent is not liable for owner-supplied information unless the agent knows otherwise.
Example
A home has an inspected septic system and a capped old well. The seller's agent attaches a groundwater hazard statement listing both to the declaration of value.
