Illinois Real Estate Recovery Fund

A fund under Sections 20-85 and 20-90 of the Illinois Real Estate License Act that compensates consumers for actual cash losses caused by a licensee's violation, such as embezzled earnest money, when a court judgment cannot be collected. Suit must start within two years, all responsible licensees must be named, and IDFPR must get written notice within 30 days of the judgment. Limits are $50,000 per aggrieved person plus costs and attorney fees, and $300,000 per licensee per transaction. Payment automatically revokes the license until repaid with interest.

Exam tip
'50 for you, 300 for all of them, revoked on payment.' The fund does not pay market-value losses or interest on the judgment.
Example
