Earnest Money Deposit Deadline (Kansas)
Under K.S.A. 58-3061, earnest money and lot deposits must be deposited in the broker's trust account within five business days after all parties have signed the agreement, unless the parties agree otherwise in writing. If the contract names a non-broker escrow agent such as a title company, the broker must deliver the agreement and the money to that agent within five business days and keep a receipt. Salespersons must promptly hand deposits to their broker.
- Exam tip
- The clock is five business days and starts when all parties have signed, not when the buyer writes the check.
- Example
- A contract is fully signed on a Monday with no holidays that week; the broker must deposit the earnest money by the following Monday.
