Community of Acquets and Gains

Louisiana's default matrimonial regime. Community property includes property acquired during the regime through either spouse's effort, property bought with community things, property donated to the spouses jointly, and the fruits of community property. Separate property generally includes property owned before marriage and property received individually by inheritance or donation. Under Civil Code art. 2347, both spouses must concur to sell, encumber or lease community immovables. Spouses may choose a separate property regime by matrimonial agreement.

Exam tip
If a married seller's house is community property, both spouses sign the listing, purchase agreement and act of sale, even if only one name is on the old deed.
Example
A wife bought a house in her name alone during the marriage with her salary; her husband must also sign the listing and the act of sale.
