Board of Registration of Real Estate Brokers and Salespersons

The Massachusetts licensing board, located within the Division of Occupational Licensure, with its statute at M.G.L. c.112 §§87PP through 87DDD½ and its rules in 254 CMR. 254 CMR 3.00 sets the professional standards of practice and 254 CMR 7.00 governs apartment rentals. Under §87AAA the Board can discipline licensees for misrepresentation, commingling, net listings, paying unlicensed persons and acting for more than one party without consent. Licensees keep required records for three years.

Exam tip
The Board disciplines, but the MCAD finds discrimination; an MCAD finding triggers a mandatory 60-day suspension (90 days for a repeat within two years).
Example
A broker accepts a net listing ('get me $500,000 net and keep the rest'); the Board can discipline her for that alone under §87AAA.
