Chapter 93A (Consumer Protection Act)

M.G.L. c.93A §2 makes unfair or deceptive acts in trade or commerce unlawful, and real estate brokerage is trade or commerce. Before suing under §9, a consumer must send a written demand letter at least 30 days before filing; the business has 30 days to tender settlement. A consumer recovers actual damages or $25, whichever is greater, plus attorney's fees, and the court may award double or treble damages for willful or knowing violations. The Attorney General may seek civil penalties up to $5,000 per violation.

Exam tip
Know the 30-day demand letter and the double-or-treble damages for willful violations; a 93A claim is in addition to any licensing violation.
Example
An agent falsely tells a buyer a basement has never leaked; the buyer sends a 93A demand letter and, if the misrepresentation was knowing, can seek up to triple damages.
