Buyer's Right of Selection (Maryland)

Maryland requires any contract for the sale of a single-family home that a licensee provides to include a bold statement that the buyer has the right to select the buyer's own title insurance company, settlement company, escrow company, mortgage lender or financial institution, and title lawyer (BOP §17-524 and §17-607). It must also say a seller may not be prohibited from offering owner financing. Omitting the statement does not void the contract but is a ground for discipline.

Exam tip
A listing agent who says 'the seller requires you to close with our affiliated title company' violates Maryland law; the buyer chooses settlement and title providers.
Example
A buyer prefers a title company her friend recommended; the seller's agent cannot require her to use the brokerage's affiliated title company.
