Missouri Escrow and Earnest Money Rules

Missouri brokers must keep escrow funds separate and may not commingle, except up to $1,000 of the broker's own money, specifically identified, to cover service charges. Earnest money must be deposited no later than 10 banking days after the last signature or initials of all parties, unless the contract says otherwise. If a dispute stays unresolved, the broker must deliver the funds to the state treasurer within 365 days of the initial projected closing date (RSMo 339.105).

Exam tip
Know the $1,000 personal-funds allowance, the 10-banking-day deposit rule and the 365-day transfer to the state treasurer.
Example
A sale set to close March 31, 2026 falls apart with both sides claiming the $8,000 deposit; if still disputed, the broker must send it to the state treasurer by March 31, 2027.
