Realty Transfer Certificate (RTC)
The form that must be completed when a Montana deed or contract for deed is recorded, declaring the consideration paid. The county clerk and recorder may not record the deed until the RTC is received (MCA 15-7-305), although a missing RTC does not invalidate the deed between the parties. Under MCA 15-7-308 the RTC is not a public record, so Montana is a non-disclosure state and sale prices are not public. The RTC also includes a water rights disclosure.
- Exam tip
- Montana sales prices are confidential because of the RTC, which is why appraisers and brokers rely heavily on MLS data for comparables.
- Example
- An appraiser cannot look up a neighbor's recorded sale price at the courthouse and instead uses MLS data for comparable sales.
