North Dakota Homestead Exemption
Under NDCC chapter 47-18, the homestead is the land where the claimant lives and the dwelling on it, protected from creditors up to $150,000 of equity over and above liens and encumbrances. There is no acreage cap, but multiple tracts qualify only if contiguous, including tracts separated only by a road. Any resident, married or single, may claim it, and filing a declaration is optional. North Dakota also has no state real estate transfer tax and is generally a non-disclosure state for sale prices.
- Exam tip
- The North Dakota limit is a dollar cap on equity ($150,000), not an acreage cap.
- Example
- An owner's home is worth $400,000 with a $300,000 mortgage; all $100,000 of equity is protected from an unsecured judgment creditor.
