72-Hour Earnest Money Rule (Nebraska)

Nebraska's trust account rule requiring earnest money to be deposited within 72 hours of written acceptance of the offer, unless all buyers and sellers agree otherwise in writing. In a cooperative sale, the selling broker deposits the funds and then promptly sends a trust account check to the listing broker (299 NAC 3-007). A title company may receive earnest money directly only if all parties agree in writing. Trust records are kept for five years.

Exam tip
The clock is 72 hours from written acceptance, and in a co-op sale it is the selling broker, not the listing broker, who makes the deposit.
Example
A seller accepts in writing at 4 p.m. Monday; the selling broker deposits the $5,000 check Thursday at 10 a.m., 66 hours later and within the rule.
