Principal Broker Surety Bond (New Hampshire)
New Hampshire protects consumers through a bond rather than a recovery fund. Under RSA 331-A:14, no principal or managing broker license is issued or renewed without a surety bond of not less than $25,000, payable to the state for the benefit of aggrieved persons. The surety's total liability to all claimants is capped at the bond amount, and the commission may revoke the license if the bond lapses. Salespersons and associate brokers do not post their own bond.
- Exam tip
- Only principal and managing brokers need the $25,000 bond; answers saying 'every licensee' or 'a recovery fund fee' are wrong.
- Example
- A newly licensed associate broker joins a firm and does not need a bond, but the firm's principal broker must keep her $25,000 bond in force to renew.
