Escrow Deposit 90-Day Release Process (New Hampshire)

Under RSA 331-A:13 and Rea 702, the principal broker keeps escrow funds in a separate account at an insured New Hampshire institution; interest belongs to the depositing party unless agreed otherwise in writing. Deposits stay until performance, written agreement of all parties or court order. If a deposit has been held more than 90 days past the closing date with none of those, the broker may send certified-mail notice to all parties, wait 60 days, and release it as stated if no one has sued or signed a release.

Exam tip
Know '90 days past closing, certified mail, 60 days wait'. The broker's own money may be in the account only for service charges or a required minimum balance.
Example
A sale was set to close June 1 and collapsed; after September 1 the broker mails notice and, absent a lawsuit within 60 days, releases the deposit as stated.
