Attorney Review (New Jersey)
A required clause in licensee-prepared New Jersey contracts for residential property of one to four units and vacant one-family lots (N.J.A.C. 11:5-6.2(g)). A warning atop the first page states the contract is binding at the end of a three-day attorney review period unless an attorney cancels it. The period is three business days from delivery of the signed contract to buyer and seller, excluding weekends and legal holidays. Disapproval notice goes to the brokers and the other party within the period.
- Exam tip
- Count three business days from delivery of the fully signed contract, skipping Saturdays, Sundays and holidays. The contract is not binding until review ends without disapproval.
- Example
- A fully signed contract is delivered to both parties on Thursday; with no holiday, attorney review runs through the following Tuesday.
