New Mexico Real Estate Commission

The body that licenses and disciplines New Mexico brokers under NMSA 61-29. It has five members appointed by the Governor: four who have been licensed New Mexico associate or qualifying brokers and one public member. Members need three consecutive years of residency, serve five-year terms, and no more than one may come from any single county. The Commission adopts rules, approves education, contracts for the PSI exam and the group E&O program, audits trust records, holds hearings and administers the Real Estate Recovery Fund.

Exam tip
'5-4-1, 5-3-1': five members, four brokers, one public; five-year terms, three years' residency, one per county. Only the Legislature can change the number of commissioners.
Example
A broker refuses to let the Commission inspect trust account records after a complaint; the refusal is itself a basis for discipline.
