Zoning Classification Statement (Pennsylvania)

A Pennsylvania agreement of sale prepared by a broker must state the property's zoning classification unless the property, or each parcel that could be subdivided from it, is zoned solely or primarily for single-family dwellings. If a required zoning statement is missing, the buyer may declare the agreement void and deposits must be returned without any court action. Other required statements include the broker's capacity, the Recovery Fund, a PennDOT highway occupancy permit notice, and who holds the deposit.

Exam tip
Three points: required unless single-family zoning, the buyer may void if omitted, and the deposit comes back without court action.
Example
An offer on a farmhouse parcel zoned R-A Rural Agricultural omits the zoning statement; the buyer may void and recover the deposit.
