Vacation Rental Act (South Carolina)
South Carolina's Vacation Rental Act governs rentals of residential property for vacation use for fewer than 90 days, managed by licensed rental management companies. Every vacation rental needs a written agreement, and tenant money goes into a trust account. When the property is sold, the buyer takes subject to rentals beginning within 90 days after the deed is recorded; later rentals need not be honored and must be refunded within 45 days after recording. The seller must disclose future rentals before contract ratification.
- Exam tip
- 'Under 90 is vacation; inside 90 the buyer keeps it; 45 to refund.' Also know the 14-day notices to the management company.
- Example
- A beach house deed is recorded March 1; an April 10 booking must be honored, but a July 4 booking need not be and must be refunded by April 15.
