South Dakota Homestead

South Dakota exempts a family's homestead, the dwelling the owner occupies plus appurtenant buildings, from judicial sale, judgment liens, and execution while it keeps its homestead character, even while listed for sale. It is limited by area: 1 acre within a town plat or 160 acres in aggregate outside one. Recording is not required. It remains liable for property taxes. When the owner is married and both spouses are South Dakota residents, the homestead cannot be conveyed or encumbered unless both spouses sign.

Exam tip
Know '1 acre in town, 160 acres rural' and that both resident spouses must sign to sell or mortgage, even if title is in one name.
Example
A married owner with the deed in her name alone wants to mortgage the family farmhouse; the lender requires both spouses' signatures.
