South Dakota Real Estate Commission (SDREC)

The South Dakota Real Estate Commission, within the Department of Labor and Regulation, administers the Real Estate Licensing Act (SDCL 36-21A) and rules in ARSD 20:69. It has five members appointed by the Governor, three active brokers and two public members, serving three-year terms with a limit of three consecutive full terms. It licenses brokers, property managers, rental agents, auctioneers, and home inspectors, and may revoke, suspend, reprimand, or fine up to $2,500. Criminal violations of the Act are Class 1 misdemeanors.

Exam tip
'5-3-2-3-3' plus the $2,500 fine. Do not confuse the administrative fine cap with the criminal penalty, which is a Class 1 misdemeanor.
Example
A broker appointed to fill the last 18 months of a vacant seat may still serve three consecutive full terms afterward, because the partial term does not count.
