property

title

Title is the legal right to own, possess, use, and control property, as well as the evidence of that ownership. It is the bundle of rights a person holds in real estate. Title is transferred by a deed, but the deed is only the document; title is the ownership itself. Title may be held by one person, several people, or an entity, and it can be legal or equitable.

Exam tip
Do not confuse title (ownership) with the deed (the document that conveys it). A buyer under contract holds equitable title until closing.
Example
At closing, the seller signs a deed that transfers title to the buyer, who records the deed to give public notice of ownership.

1. In a deed, the party conveying title is the ____ and the party receiving title is the ____.

Answer & explanation

Answer: A. The seller (grantor) conveys to the buyer (grantee). A deed is the document; title is the ownership rights it transfers.
