TREC Promulgated Forms
TREC promulgated forms are standard contracts, addenda, and notices adopted by the Texas Real Estate Commission and drafted by the Broker-Lawyer Committee so license holders can avoid the unauthorized practice of law. TREC rules generally require a license holder to use the promulgated form when one exists, such as the One to Four Family Residential Contract (Resale) 20-19. License holders may fill in blanks with facts and business details and strike language at a principal's direction, but may not draft legal language or give legal advice.
- Exam tip
- 'Fill, don't draft.' Exceptions to mandatory use include acting solely as a principal, an attorney-prepared form required by a principal, a government form, or no TREC form existing.
- Example
- A buyer wants a clause to cancel if his divorce is not final by May 1; the agent recommends an attorney draft it rather than writing her own termination language.
