Utah Division of Real Estate and Real Estate Commission

Utah real estate practice is governed by the Real Estate Licensing and Practices Act (Utah Code 61-2f) and rules R162-2f. The Division of Real Estate, in the Department of Commerce, issues licenses, investigates, audits trust accounts, and manages the Recovery Fund. The Real Estate Commission, with Division concurrence, writes rules, holds hearings, and imposes sanctions. The Commission has five governor-appointed, Senate-confirmed members: four licensees with five years' experience and one public member, serving four-year terms with a two-consecutive-term limit.

Exam tip
Rules come from the Commission (with Division concurrence); processing, investigating, and auditing come from the Division. 'The Department of Commerce' is a tempting wrong answer. Memory aid: '5-4-1, 4 and 2.'
Example
A complaint about a sales agent is investigated by the Division, and the Commission holds the hearing and, with the director's concurrence, imposes the sanction.
