State-Approved Forms (Utah)

Under Utah Code 61-2f-306, a licensee generally may fill out only forms approved by the Real Estate Commission and the Attorney General, or forms provided by statute. The approved list includes the Real Estate Purchase Contract (REPC), the blank addendum, Seller Financing Addendum, FHA/VA Loan Addendum, Assumption Addendum, lead-based paint forms, and the Earnest Money Deposit with Title Company Addendum. Licensees may also fill out forms prepared by a party's attorney, or any attorney's form when no approved form exists. Principal brokers may fill out closing documents.

Exam tip
A favorite 'not state-approved' answer is the listing agreement. Counteroffers go on an approved addendum, never by altering the REPC boilerplate.
Example
To counter a $525,000 offer at $535,000, an agent writes Addendum No. 1 instead of crossing out the price on the REPC.
