Homestead Spousal Signature Rule (Wisconsin)

Under Wisconsin's conveyance statute (Wis. Stat. 706.02(1)(f)), a conveyance that alienates a married person's homestead interest must be signed by, or joined in by separate conveyance of, each spouse, even if only one spouse holds title. Exceptions are conveyances between spouses and purchase-money mortgages. Courts treat the requirement as non-waivable, and a missing spouse's signature can make the transaction void. Wisconsin is also a marital property state and a race-notice recording state.

Exam tip
'Home needs both hands.' Know the two exceptions: between spouses and purchase-money mortgages.
Example
Mark owns the family home in his name alone and accepts an offer that Lisa never signs; the buyer cannot enforce the sale without her signature.
