Fair Housing Exemptions, Familial Status Only (West Virginia)

West Virginia's Fair Housing Act exemptions are much narrower than federal law. The private single-family owner exemption (owner of no more than three houses, selling or renting without a broker or discriminatory ads) and the owner-occupied building of up to four families apply solely for purposes of familial status. They never permit discrimination based on race, color, religion, ancestry, sex, blindness, disability, or national origin. The exemption is lost as soon as a licensee is used.

Exam tip
'Three houses, four units, one class.' If a question asks whether a private single-family owner may refuse a renter because of race in West Virginia, the answer is no.
Example
An owner living in one unit of her fourplex may rely on the exemption regarding a family with a toddler, but not to reject an applicant because of religion.
