Statement of Consideration and Non-Disclosure (Wyoming)
Wyoming is a non-disclosure state. When a deed or other title-transfer document is recorded, the parties file a Statement of Consideration with the county clerk reporting the price and terms, but under W.S. 34-1-142 these statements are not public records and must be kept confidential by the clerk, assessor, and boards. Licensees therefore rely on MLS data and their own files for comparable sales and must not leak confidential information. Wyoming also has no state or local real estate transfer tax, only county recording fees.
- Exam tip
- Remember the Statement of Consideration is confidential, not a public record. Do not apply a transfer tax calculation to a Wyoming sale.
- Example
- A licensee preparing a CMA in Cheyenne pulls sold prices from MLS records, since recorded Statements of Consideration are not publicly available.
