abstract of title

An abstract of title is a condensed history of a property's title, summarizing every recorded deed, mortgage, lien, judgment, and other document affecting it, in order. It is prepared by an abstractor or title company from public records. An attorney may review the abstract and give an opinion of title. The abstract only reports what is recorded and does not guarantee title, unlike title insurance.

Exam tip
An abstract summarizes records; an attorney's opinion interprets them; title insurance protects against loss. Only title insurance pays if a hidden defect appears.
Example
Before closing, the buyer's attorney reviews a 40-page abstract of title listing every transfer since 1920.
