agency disclosure
Agency disclosure is the requirement that a licensee tell consumers whom the licensee represents in a transaction, and often explain the types of agency relationships available. Many states require a written disclosure at the first substantive contact, before confidential information is discussed. Timing, forms, and required wording vary by state. Proper disclosure helps prevent undisclosed dual agency and consumer confusion.
- Exam tip
- Timing is the common test: disclosure usually comes at first substantive contact, not at closing or when the offer is written.
- Example
- At an open house, before a visitor begins discussing how much she can afford, the agent explains that he represents the seller.
