Alabama Real Estate Brokerage Services Disclosure Form

The single Commission-written form every Alabama company uses (Rule 790-X-3-.13) to explain single agency, dual agency, and transaction facilitation, the duties owed to all parties, and how the company is paid. It must be given as soon as reasonably possible, before confidential information is disclosed, and in any event before any brokerage service, including showing a property. The licensee signs and dates it; the consumer is not required to sign. Open houses, rentals, and entity transactions are exempt.

Exam tip
Form before showing, agreement before offering. The consumer's signature is not required; if the consumer declines, the licensee notes the refusal.
Example
Before unlocking a vacant listing, an agent hands a couple the form, signs and dates it, and writes 'consumer declined to sign' when they refuse. He may then show the home.
