Affidavit of Disclosure (Arizona)

A notarized disclosure required by A.R.S. 33-422 when a seller sells five or fewer parcels of land, other than subdivided land, in an unincorporated area of a county. It covers legal and physical access, road maintenance, floodplain, utilities, water source including hauled water, septic, and zoning compliance. The seller must furnish it at least seven days before transfer, the buyer may rescind within five days after receiving it, and it is recorded with the deed. Waivers of the seller's liability for misstatements are void.

Exam tip
All three conditions must apply: unincorporated area, five or fewer parcels, not subdivided land. Seven to deliver, five to flee.
Example
A seller gives the buyer the affidavit for a 10-acre parcel in unincorporated Yavapai County on June 1. The buyer learns it relies on hauled water and may rescind through June 6.
