Seller's Property Disclosure Statement (SPDS)

The Arizona REALTORS form sellers use to meet the disclosure duty that Arizona grounds in case law (Hill v. Jones) rather than a mandatory statutory form. It covers ownership, building and safety, utilities, water source, sewer or septic, and environmental issues. The seller, not the agent, completes it. Under the AAR resale contract it is due within three days after acceptance, and the insurance claims history within five days; the buyer may object within the Inspection Period or five days after receipt, whichever is later.

Exam tip
'Three for the SPDS, five for the claims.' Arizona's seller disclosure duty comes from common law, not a statute requiring a specific form.
Example
A Mesa seller checks 'no' for pest damage on the SPDS although she painted over termite damage. She faces fraud liability, and a knowing agent faces ADRE discipline.
