Disclosure Regarding Real Estate Agency Relationship (California)
California's statutory agency form under Civil Code §§2079.13-2079.24, used for one-to-four-unit residential, mobilehome, commercial, and certain lease transactions. The process is disclose, elect, confirm. The listing agent gives the form to the seller before the listing agreement; the buyer's agent gives it to the buyer before a buyer-broker agreement and before an offer. The agency relationship is then confirmed in the purchase agreement or a separate writing. Two salespeople under one broker on opposite sides make the broker a dual agent.
- Exam tip
- Disclosure and confirmation are different steps: the form comes early, and confirmation goes in the purchase contract.
- Example
- Two salespeople of the same Fresno broker represent the seller and the buyer. The purchase agreement confirms the broker as a dual agent, and neither may reveal that the seller would take $20,000 less.
