Natural Hazard Disclosure Statement (California)
A map-based disclosure under California Civil Code §§1103-1103.15 stating whether a property lies in any of six hazard areas: a FEMA Special Flood Hazard Area, a dam failure inundation area, a High or Very High Fire Hazard Severity Zone, a wildland area with substantial forest fire risk, an Earthquake Fault Zone, or a Seismic Hazard Zone. Most sellers hire a third-party report provider, which shields them if they used reasonable care. Late delivery triggers the same 3-day or 5-day termination right as the TDS.
- Exam tip
- Memory aid: two waters, two fires, two quakes. The NHD is based on official maps, not on the seller's personal knowledge.
- Example
- An Oakland hills seller's NHD report shows a Very High Fire Hazard Severity Zone and an Earthquake Fault Zone, and both must be disclosed to the buyer.
