Real Estate Transfer Disclosure Statement (TDS)
The statutory form in California Civil Code §1102.6 on which sellers of one-to-four-unit residential property disclose what they know about the property's condition, with separate sections for the listing agent's and buyer's agent's visual inspections. It is not a warranty. It must be delivered as soon as practicable before transfer of title. If it or a material amendment arrives after the buyer signs an offer, the buyer may terminate within 3 days of in-person delivery or 5 days of mail delivery. 'As is' sales are not exempt.
- Exam tip
- 'Three by hand, five by mail; as is won't get you bail.' Court-ordered, foreclosure, fiduciary, spouse, and government transfers are exempt.
- Example
- Buyers sign an offer June 1 and the seller hand-delivers the TDS June 3. The buyers have until June 6 to terminate; if it had been mailed, until June 8.
