Commission-Approved Forms (Colorado)
Standard contracts and disclosures approved by the Colorado Real Estate Commission, which brokers must use when one exists for the transaction, subject to Rule 7.1 exceptions. Brokers fill in facts and business terms but do not draft legal language, which would be the practice of law. The set includes listing contracts, the Contract to Buy and Sell Real Estate, addenda, the Seller's Property Disclosure, closing instructions, deeds of trust, and deeds. Exceptions include builder and REO seller forms and attorney-prepared forms.
- Exam tip
- 'Fill, don't draft.' If an approved form exists and no exception applies, the broker must use it.
- Example
- A national builder requires its own purchase agreement. The buyer's broker may help but must not interpret its indemnity clauses and should recommend attorney review.
