fee simple absolute

Fee simple absolute is the highest and most complete form of ownership interest in real property. The owner holds the full bundle of rights for an unlimited duration and may sell, lease, mortgage, give away, or will the property to heirs. It is not subject to any conditions that could end the estate, although it remains subject to government powers such as taxation, eminent domain, police power, and escheat.

Exam tip
Exams often ask which estate is the most complete or inheritable without limitation; the answer is fee simple absolute, not fee simple defeasible or a life estate.
Example
A buyer purchases a house with a general warranty deed and no conditions attached. She owns it in fee simple absolute and can leave it to her children in her will.
