agency
BRRETA (Brokerage Relationships in Real Estate Transactions Act)
Georgia's agency statute (O.C.G.A. §10-6A-1 et seq.), which says a broker owes clients and customers only the duties in the chapter unless a signed writing adds more, and that the broker is not a fiduciary. A client is represented under a written brokerage engagement; a customer is not represented but may receive ministerial acts. BRRETA also permits dual agency with written consent, designated agency (not dual agency), and transaction brokerage. Written disclosure of whom the firm represents is due no later than the first offer.
- Exam tip
- 'No paper, no client.' Be wary of answers saying Georgia brokers owe common-law fiduciary duties; BRRETA expressly says they are not fiduciaries.
- Example
- A buyer tours homes with an agent from an open house without signing anything. She is a customer, and the agent's firm must disclose whom it represents before she makes an offer.
